Abstract

The International Chamber of the Court of Appeal of Paris (ICCAP) has been created on 7 February 2018 in this movement of modernizing its law with the view to making the French civil judicial system attractive, more efficient and less expensive, for international litigants. The judicial system set up by the creation of the ICCAP is characterized by the scope of disputes allocated to it and the rules applicable, which derogate from the French Code of Civil Procedure. More generally, the ICCAP has jurisdiction over appeals against any first instance decision rendered in respect of international economic and commercial disputes. Salient features of the rules set are the language of the proceedings, the procedure for submission of evidence and the mandatory procedural timetable. The first advantage of having a dispute adjudicated by the ICCAP is the possibility of submitting evidence in English without translation Second, the use of English is allowed for the parties, experts and third party witnesses appearing before the Court as well as legal counsels who are not French nationals. Moreover, before the ICCAP, parties benefit from a fast-paced judicial procedure thanks to mandatory procedural timetables set up by the judge together with the parties, pursuant to which the dates for the appearance of the parties, the filing of submissions and documents, the hearing of witnesses and experts, as well as final oral arguments are set in advance.
