Controversial aspects of objective arbitrability in oil and natural gas concession contracts

This article aims to present the notion of objective arbitrability in the oil and natural gas sector. In a given case, it is possible to notice that the National Agency of Petroleum, Natural Gas and Biofuels - ANP - has sought to rule out the applicability of the arbitration clause provided for in the concession contracts, including the filing of lawsuits, in order to remove some contractual controversies from the arbitration analysis and to preserve its regulatory authority. At the end, the text proposes the respect of contractual clauses, including the arbitration clause, with the implementation of the principles of protection of legitimate expectations and legal security, inherent to the prosperity of the oil and gas sector.
