Arbitration in Brazil: are users really happy?

Abstract

Since the enactment of the 1996 Arbitration Act, arbitration in Brazil has boomed. The he country currently is one of the main arbitration users worldwide. However, the main arbitration’s participant-the client- is notfully pleased. This article discusses the arbitration’s upsides, taking into consideration what are the clienfs main complains. It elaborates on each arbitration’s weakness and provides possible solutions to enhance even more the practice of arbitration in Brazil.
