Novas regras de arbitragem na China continental

Resumo

As instituições arbitrais chinesas utilizam ferramentas de inteligência artificial (IA). A Comissão de Arbitragem de Guangzhou (GAC) introduziu o chamado assistente de arbitragem por IA, que permite não apenas a interpretação simultânea, mas também a criação automática de transcrições nos procedimentos arbitrais. Os principais objetivos da pesquisa são: examinar as mudanças recentes nas regras de arbitragem das instituições chinesas, com foco na digitalização e na integração de ferramentas baseadas em IA; e avaliar o potencial dessas inovações para influenciar os padrões internacionais de arbitragem. Assim, a análise levanta a questão de quais soluções, desenvolvidas pelas principais instituições de arbitragem da China, poderão ser adotadas globalmente. Conclui-se que a China está determinada a adaptar sua legislação nacional, inclusive em áreas sensíveis como a arbitragem ad hoc, para se consolidar como um centro de resolução de disputas plenamente reconhecido, alinhado aos padrões internacionais.
