Causas de litígios de Direito Civil entre sujeitos de atividade empresarial

Este estudo examina as causas dos litígios de direito civil entre entidades empresariais no Cazaquistão, comparando-as com disputas semelhantes nos Estados Unidos, no Reino Unido e na China. Utilizando uma abordagem analítica comparativa, a pesquisa analisa dados estatísticos provenientes de fontes jurídicas oficiais e de sites especializados, abrangendo o período de 2015 a 2022. A análise identifica como principais fatores geradores de litígios as violações de cláusulas contratuais relativas a pagamento e entrega, conflitos de propriedade e práticas comerciais fraudulentas. Apesar das diferenças entre os contextos nacionais, o estudo constata que a maioria das disputas decorre de falhas de entendimento sobre arranjos financeiros, gestão contratual e autoridade decisória. O artigo também avalia a eficácia do arcabouço jurídico cazaque, destacando a limitada implementação prática de mecanismos de resolução alternativa de disputas, como mediação e arbitragem. Os resultados contribuem para o debate sobre o aperfeiçoamento dos processos de resolução de conflitos, propondo reformas que visam alinhar o sistema jurídico do Cazaquistão às melhores práticas internacionais, de modo a apoiar a atividade empreendedora e reduzir a sobrecarga do Judiciário.
