Resumo

A inteligência artificial (IA) está transformando o campo jurídico, incluindo a mediação como um mecanismo de resolução alternativa de disputas. Embora as ferramentas de IA possam aumentar a eficiência, a acessibilidade e a capacidade preditiva, sua integração na mediação gera preocupações relacionadas à confidencialidade e à confiança. A confidencialidade sempre foi um princípio fundamental da mediação; entretanto, quando dados sensíveis são processados por sistemas de IA, surgem riscos ligados à proteção de dados, à supervisão e à confiança pública. Este artigo examina os de-safios jurídicos e regulatórios da incorporação da IA na mediação no Cazaquistão. São analisados os padrões internacionais, em especial o princípio da privacidade desde a concepção (privacy-by-design) da União Europeia, comparando-os com a legislação cazaque existente. O estudo evidencia lacunas legais significativas: as normas nacionais protegem dados principalmente em fase operacional, mas não exigem a integração da privacidade desde a etapa de concepção dos sistemas de IA. Utilizando métodos doutrinários, comparativos e de benchmarking regulatório, o artigo identifica fragilidades no arcabouço jurídico e propõe recomendações para alinhá-lo às melhores práticas internacionais. A aná-lise confirma que, sem salvaguardas robustas, a mediação apoiada por IA corre o risco de minar a confiança em vez de fortalecê-la. Contudo, com reformas direcionadas, o Cazaquistão pode criar um marco regulatório que equilibre inovação tecnológica e proteção de direitos fundamentais, promovendo maior confiança na mediação digital.
