The Role of Trade Unions as a Subject of Social Partnership in Resolving Labour Disputes

Resumo

The relevance of this scientific work which focuses on trade unions as subjects of social partnership to resolve labour disputes lies in the need to enhance the role of trade union organisations in the mechanism of implementation of social partnership activities in resolving labour disputes. The purpose of this article is to conduct an analysis of trade union activities in general, highlighting its main characteristics and principles on which such activities are based, and also to investigate what is the role of trade unions as the subjects of social partnership. The scientific work was aimed at revealing both theoretical and practical aspects. Such methodological approaches include theoretical and methodological, dialectical and methodological, deduction method, induction method, logical analysis method, synthesis method, and others. Thus, in the course of the research, it was revealed that trade
unions play a rather important role in the formation of civil society and in improving the mechanism of social and labour relations. In addition, the mechanism of trade unions as subjects of social partnership in resolving labour disputes was analysed in detail, and the problems that stand in the way of the proper functioning of participation of trade union organisations in social partnership were identified. The results of the study will contribute to the development of methodological recommendations to help resolve problems related to trade union participation in social partnerships and to enhance the role of cooperation between trade unions and employers in the settlement of labour disputes.

He is a corresponding member of the National Academy of Legal Sciences of Ukraine.

Olena Moskalenko

Full Doctor in Law, Dean of the Faculty of Management, Administration and Law, State Biotechnological University, Kharkiv, Ukraine. Her scientific achievements are 70 scientific papers. Among them are the monographs “Basic principles of compulsory state social insurance in a market economy”, “Legal relations on compulsory state social insurance: a theoretical aspect”.

Olena Sereda

Full Doctor in Law, Head of the Department of Labor Law, Yaroslav Mudryi National Law University, Kharkiv, Ukraine. Basic scientific researches: subjects of labor law; employment contract, international social standards; atypical forms of employment; supervision and control over compliance with labor legislation. She is the author of the dissertation “Employer as a subject of labor law” and the monograph “State and legal mechanism for the protection of workers’ rights in the context of Ukraine’s integration into the European Union.”

Mykola Inshyn

Full Doctor in Law, Head of the Department of Labor and Social Security Law, Taras hevchenko National University of Kyiv, Kyiv, Ukraine. Professional interests: problems of labor law, social security law; guarantees of labor and social rights; problems of labor protection. He is the author of more than 320 scientific and educational works.

Yuliia Burniagina

PhD in Law, Assistant Lecturer at the Department of Labor Law, Yaroslav Mudryi National Law University, Kharkiv, Ukraine. Her main research interests: local regulation in the system of legal regulation of wages, problems of legal regulation of employee bonuses, some aspects of collective bargaining, as well as new current trends in labor law and social security law. She is the author of the dissertation “Local legal regulation of wages”.
