Abstract

Austrian Mediation Act (Zivilrechts-Mediations-Gesetz) was enacted in 2003, 12 (twelve) years before the Brazilian Mediation Act (2015), with the purpose of regulating mediation in civil matters. The Austrian Mediation Act approaches essential issues in the field of mediation in civil cases, such as the definition of a mediator, his or her preparation to become one and, most importantly, the rights and duties of the mediators duly registered with the Austrian Federal Ministry of Justice.

Advogado Atuante na área de Arbitragem e Contencioso Cível do escritório de advocacia Stüssi-Neves Advogados. Mestre (LL.M.) em Resolução de Disputas Internacionais pela Humboldt-Universität zu Berlin (Alemanha). Graduado em Direito pela Pontifícia Universidade Católica do Rio de Janeiro. Membro do Comitê Brasileiro de Arbitragem, do DIS40 – Iniciativa Alemã de Jovens Árbitros e do Grupo de Estudos em Arbitragem e Direito do Comércio Internacional da Pontifícia Universidade Católica do Rio de Janeiro (GEADICI).
