Abstract

The purpose of this paper is to conduct a comparative legal analysis of selected topics of arbitration and its current use by the public administration in Brazil and Portugal. Thus, we begin narrating the history of arbitration in Brazil in order to proceed with a comparative analysis of some institutes of this alternative method of conflict resolution such as: Arbitrability, Arbitral Award Review, Annulment of Arbitration Awards, Enforcement of Arbitral Award, Challenges in Execution, the duty of publicity and the use of institutional arbitration. Finally, common ground and distinctions are established between both jurisdictions.
